Why INEC Is Challenging Court Orders on 2027 Election Timetable – Chairman Amupitan

Electoral Commission Seeks Judicial Clarification on Its Powers to Regulate Election Timelines Ahead of 2027 General Elections

The Chairman of the Independent National Electoral Commission (INEC), Joash Amupitan, has explained why the commission is contesting recent court judgments concerning the timetable for the 2027 general elections.

According to Amupitan, INEC’s decision to appeal the rulings is aimed at protecting its constitutional mandate and obtaining a clear judicial interpretation of its powers regarding the conduct and management of elections in Nigeria.

The controversy arose following judgments by the Federal High Court on aspects of the commission’s election timetable, particularly deadlines relating to political party primaries, candidate nominations, and substitutions.

While the court affirmed INEC’s authority to issue election timetables and regulate pre-election activities, it ruled that the commission cannot shorten statutory timelines provided under the Electoral Act for the submission and substitution of candidates.

Amupitan stated that INEC believes certain legal issues raised in the judgments require clarification by higher courts to avoid uncertainty and potential challenges in the administration of the 2027 elections.

He noted that the commission’s appeal is not an attempt to disregard judicial authority but rather a lawful effort to secure a definitive interpretation of the Constitution and the Electoral Act.

The INEC chairman warned that conflicting interpretations of the commission’s powers could affect the smooth coordination of electoral activities and create confusion among political parties and stakeholders.

The commission maintains that obtaining judicial clarity is essential to ensuring a transparent, orderly, and credible electoral process as preparations for the 2027 general elections gather momentum.
