National Industrial Court Grants Injunction Against Industrial Action in Abuja

The National Industrial Court of Nigeria (NICN), Abuja Division, has ordered workers under the Federal Capital Territory Administration (FCTA) to suspend their ongoing strike. The injunction follows a suit filed by the Minister of the Federal Capital Territory, Nyesom Wike, and the FCT Administration, seeking to restrain the Joint Union Action Committee (JUAC) and its members from continuing industrial action, picketing, or lockouts.

Delivering the ruling on Tuesday, Justice E.D. Subilim noted that while the dispute qualifies as a trade dispute under the law, the right to strike is not absolute once a matter is before the National Industrial Court. He emphasized that any ongoing strike must be halted pending the court’s determination of the case.

“An order of interlocutory injunction is hereby granted, restraining the claimants and representatives… from further embarking on any industrial action against the claimant. The order shall remain in force, pending the determination of this suit,” Justice Subilim stated.

The court has adjourned the substantive hearing to March 23, 2026, giving parties time to present their full arguments. The strike, which had disrupted FCTA operations, is now suspended as the legal process continues.
