Landmark judgment rules colonial-era killings unlawful, orders apology and damages from UK government for the families of 21 slain miners

A Nigerian court has ordered the United Kingdom (UK) government to pay £420 million in compensation to the families of 21 coal miners killed in Enugu in 1949, marking a landmark ruling on colonial-era human rights violations.

The judgment, delivered on February 5, 2026, relates to the Iva Valley coal miners massacre, where British colonial police shot unarmed Nigerian miners who were protesting poor working conditions, wage discrimination, and unpaid allowances under colonial rule.

The court held that the killings amounted to unlawful and extrajudicial violations of the right to life, stressing that the passage of time does not absolve responsibility for grave human rights abuses. It awarded £20 million in damages to each of the 21 affected families, bringing the total compensation to £420 million, with 10 percent annual post-judgment interest until full payment.

In addition to the financial award, the court directed the British government to issue a formal and unreserved public apology to the families of the slain miners, to be published in major newspapers in Nigeria and the United Kingdom (UK).

The judge dismissed claims of sovereign immunity, ruling that colonial-era actions resulting in loss of life remain justiciable under Nigerian law. The court also faulted decades of official silence over the massacre, emphasizing that justice delayed should not amount to justice denied.

Human rights advocates have described the ruling as a significant step toward accountability for colonial injustices, noting that the Iva Valley massacre of November 18, 1949, remains one of the darkest chapters in Nigeria’s labour and nationalist history and a catalyst for the country’s anti-colonial struggle.
